1. Introduction

Wellbeing Warrior (“Wellbeing Warrior”, “we” or “us”) takes privacy very seriously and will only use personal data in accordance with this Privacy Notice (“Notice”). This Notice describes what personal data are collected, how Wellbeing Warrior uses, stores, accesses, and every other detail regarding personal data.

3. Data collected by Wellbeing Warrior

Wellbeing Warrior collects personal data when you use or register on our website and/or when you use our services. Data may be collected for several reasons, including when (a) processing an order, data is collected to deliver the order; (b) you fill out the “Contact us” web form or customer support is needed, data is collected to contact you; or (c) using our services, data is collected to provide those services.

Wellbeing Warrior only collects personal data for marketing reasons when you sign up to receive our emails, newsletters and/or further information about our products and services. For the purposes of our legitimate interests, we will use your personal data to create a profile based on the information we hold about you. We create your profile in accordance with your preferences and the way you interact with us, in order to provide you with the best personalised experience.

Personal data may be provided by you when filling out our “Contact us” web form. We may also collect usage data by using cookies. Cookies only identify the interaction that a specific device has with us, but do not identify the individual using it nor collect any personal data stored on that device.

Wellbeing Warrior only collects personal data when you give us consent and may collect: name, contact data, credentials, usage data, content of communications with us, and any further information provided by you.

4. Storage, usage and disclosure of personal data

Where you have provided consent or requested a service, we may use your information to:

  • Provide our services;
  • Process orders submitted by you;
  • Carry out our obligations under contracts;
  • Contact you when you fill out the “Contact us” web form;
  • Send you communications and/or notifications necessary under contracts;
  • Contact you to further discuss our services and to send you information regarding Wellbeing Warrior.

5. Security precautions

Wellbeing Warrior undertakes to treat the Personal Data as absolutely confidential and to use it exclusively for the stated purposes. Wellbeing Warrior also guarantees that it has taken appropriate technical, administrative and organizational facilities, systems and processes necessary to ensure the safety of personal data and avoid its alteration, loss, theft, or unauthorized disclosure. To that effect, Wellbeing Warrior will implement and maintain measures such as:

  • Physical access control, such as security personnel and secured buildings;
  • System access control, such as authentication via passwords, documented authorization processes, and logging of access on several levels;
  • Logical access to the data centers is restricted and protected by firewall;
  • Security processes such as intrusion detection system, centralized logging and alerting, and firewalls;
  • Personal Data are accessible and manageable only by properly authorized staff, direct database query access is restricted, and application access rights are established and enforced;
  • Transfers of data outside the Wellbeing Warrior Service environment are encrypted.

6. Who has access to data

Wellbeing Warrior uses third-party service providers to complete specific tasks and to provide our services to you and we may share your personal data with them for these purposes.

When we use external providers, we only disclose personal data that is necessary for the specific services and we enter into a contract with the third-party service providers to ensure that they keep your personal data secure. Third-party service providers do not have authorisation to use the data for marketing purposes, unless you have provided consent or tell us to do so.

Wellbeing Warrior will disclose personal data where required: (a) by law, legal proceedings, orders of a valid injunction from a court or other legal enforcement entity, law enforcement or regulatory authorities; (b) to protect and defend our legal rights; (c) to protect your vital interests; or (d) to protect Wellbeing Warrior’s safety.

Wellbeing Warrior does not sell, share or trade any personal data with third parties for their promotional purposes.

7. Your rights

You have the following rights with regard to personal data that is collected and/or processed by Wellbeing Warrior. If you wish to exercise any of these rights, please reach out to us by email at privacy@wellbeing-warrior.com.

(a) Right of access:

You have the right to obtain from Wellbeing Warrior confirmation as to whether or not your personal data are being processed, and, where that is the case, access to the personal data and the following information:

  • The purposes of the processing;
  • The categories of personal data concerned;
  • The recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
  • Where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
  • Where the personal data are not collected from the data subject, any available information as to their source;
  • If applicable, the existence of automated decision-making.

(b) Right of rectification:

You have the right to request Wellbeing Warrior to rectify your information when it is inaccurate. This includes the right to have incomplete personal data completed, including by means of providing a supplementary statement.

(c) Right to be forgotten:

You have the right to request Wellbeing Warrior to erase your personal data. In such cases, Wellbeing Warrior will have the obligation to erase personal data without undue delay where one of the following grounds applies:

  • The personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • You withdraw consent on which the processing is based and where there is no other legal ground for the processing;
  • You object to the processing pursuant and there are no overriding legitimate grounds for the processing;
  • The personal data have been unlawfully processed;
  • The personal data have to be erased for compliance with a legal obligation in Union or Member State law to which Wellbeing Warrior is subject;
  • The personal data have been collected in relation to the offer of information society services.

(d) Right to restrict processing:

You have the right to request Wellbeing Warrior to restrict the processing of your personal data if:

  • You contest the accuracy of your personal data;
  • The processing is unlawful;
  • We no longer need the personal data for the purposes of the processing but you have required us to retain the information for a legal claim;
  • You have objected to the processing and a verification of our legitimate interests is pending.

(e) Right to data portability:

You have the right to request Wellbeing Warrior to provide you with an electronic file of your information, or to transmit your personal data to another controller without hindrance from the controller to which the personal data have been provided.

(f) Right to lodge a complaint:

You have the right to lodge a complaint with a supervisory authority.

8. Use of 'cookies'

Wellbeing Warrior’s website uses cookies. A cookie is a text-only string of information that a website transfers to the cookie file of the browser on your computer's hard disk so that the website can recognize you when you revisit and remember certain information about you. This can include which pages you have visited, choices you have made from menus, any specific information you have entered into forms and the time and date of your visit.

9. List of cookies

The Cookies currently used by Wellbeing Warrior’s Website and its function are session cookies. These are temporary cookies that expire at the end of a browser session; that is, when you leave the site. Session cookies allow the website to recognize you as you navigate between pages during a single browser session and allow you to use the website most efficiently. They allow Wellbeing Warrior to maintain a certain level of security and verify your details whilst you use the website as you navigate from page to page, which enables you to avoid having to re-enter your details each time you enter a new page. 10. Use of third parties

(a) Google Analytics

This website uses Google Analytics. The operator of this service is the company Google Ireland Limited, Google Building Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland. Google Analytics is a web analysis service, and, by placement of cookies and the information acquired by this, it enables us to make inferences about user behavior on our website. The information generated by the cookies is sent to a Google server in the USA and stored there. Our website uses the service Google Analytics on an exclusively pseudonymous basis. Your IP address is only recorded in abbreviated form and is hence anonymized.

(b) Transferring your information

On rare occasions, Wellbeing Warrior may transfer your personal data to third parties outside your country of domicile, potentially to countries outside the European Union region and/or countries which may not require the same level of protection for your personal data compared with that provided in your country. For example, when you use our services outside your country of domicile, external providers may be necessary.

In such rare cases, Wellbeing Warrior ensures there are adequate safeguards in place when transferring data or that the transfer only occurs where permitted by applicable law, to ensure your data continues to be protected as defined in this Notice.

11. Data Retention

Wellbeing Warrior keeps personal data in a form that permits your identification for no longer than is necessary for the purposes for which it was processed. Unless a different retention period is required by law (e.g., tax laws) or necessary for legal proceedings, we will keep your personal data for two years from your last interaction with us.

We review our retention periods on a regular basis.

12. Marketing Opt Out

If you would like to opt out from receiving our marketing communications, you may use the easy unsubscribe link available in the messages we send you. Alternatively, you may contact us by email at privacy@wellbeing-warrior.com.

If you opt out from our marketing communications, we will continue processing your personal data in the manners explained in this Notice, we will just no longer send you marketing messages. If you want us to stop processing your personal data, please check how to do so above.

By using our services, you accept this Notice.

Wellbeing Warrior regularly reviews this Notice to ensure that it is in line with the current legal requirements at all times. We reserve the right to amend it. This Notice was last updated in January, 6 2022
